Privacy Policy

Clarity Performance LLC("Clarity Performance", "we", "us") runs the Clarity Performance training app and website at clarity-performance.com. This policy explains what personal information we collect from you, why we collect it, who else touches it, how long we keep it, and what you can ask us to do with it.
We have written it in plain English on purpose. If anything here is unclear, email daniel.baker@clarity-performance.com and ask.
1. Who this policy covers
Everyone who uses the Clarity Performance app or website, whether you are on the free logging tier, a paid self-serve subscription, or 1:1 coaching. Where a specific tier collects something the others do not, we say so.
2. What we collect
2.1 Account information
When you create an account we collect your name, your email address and a username you choose. Your account record and your sign-in credentials are held by Clerk, our authentication provider, not by us directly. We can see your name, your email and your session activity. We never see or store your password.
2.2 Payment and subscription information
If you buy a subscription, payment is handled by Stripe. We store:
- whether your subscription is active, trialing, past due, cancelled or unpaid
- which plan you are on
- your Stripe customer ID and your Stripe subscription ID
- the date your current paid period ends
We never see, receive or store your card number, expiry date or security code. Those go directly to Stripe and stay with Stripe.
2.3 Your liability waiver and your health questionnaire
This is the most sensitive information we hold, so it gets its own section.
Before we generate a training program for you, we require you to sign a liability waiver and complete a health and readiness questionnaire. Depending on which flow you come through, that can include:
- your full legal name, typed as an electronic signature, and the date you signed
- your date of birth, which we use to confirm you are 18 or older, because a minor cannot sign an enforceable waiver
- your phone number, if you give one
- an emergency contact name and phone number
- whether you have any diagnosed medical conditions, and your description of them if you say yes
- whether you are currently in pain or injured, and where
- whether a medical professional has advised you to avoid exercise
- whether you take medication that affects exercise
- whether you have had surgery in the past two years
- movement patterns you need to avoid, and any free-text injury notes you write
- your self-reported working maxes for particular lifts, if you provide them
- your training experience level, available equipment, chosen training focus and how many days a week you train
This is health information. We understand that it is more sensitive than your name and email, and we treat it that way. We collect it for two reasons, and only these two:
- Safety and legal record. We need to know what you have told us about your body before we tell you what to do with it, and we need a durable record of what you signed and when.
- Programming. Your answers feed directly into which exercises the app selects for you. If you flag a movement pattern to avoid, the program generator excludes it. This is not a form we file and forget.
We do not sell this information, we do not use it for advertising, and we do not share it with anyone outside the list in section 4.
We are not a healthcare provider. Clarity Performance is not a doctor, a physical therapist, a health plan or a healthcare clearinghouse, so the health information you give us is not protected health information under HIPAA. We are telling you that because it is better for you to know which rules do apply than to assume protections that do not. The rules that do apply to us, including consumer protection and state privacy law, are what this policy is written against.
2.4 Training data
As you use the app we store what you log:
- workout sessions, and whether they were completed
- individual sets, reps and weights
- cardio activity type, duration, distance and pace
- exercises you add yourself that are not in our library, stored against your account only and never shared with other users
- the training program generated for you, and its week by week history
2.5 Streaks, XP and levels
We calculate and store your current streak, your longest streak, your accumulated XP and your level.
2.6 Friends and the leaderboard
If you connect with other users, we store the connection between your accounts. The app then shows a friends-only leaderboard. Anyone you are connected with can see your username, your streak and your level. They cannot see your health questionnaire, your waiver, your billing information, or the detail of your individual workouts through the leaderboard.
Your username, not your email address, is what other users see. Friend requests can be sent using either a username or an email address, so someone who already knows your email can find you with it, but your email is never displayed to your connections.
You choose whether to connect with someone. If you do not want your streak and level visible to another person, do not accept or send that connection, or remove it.
2.7 Photos and comments you post
If you attach a photo to a logged workout, or write a text comment on a workout, we store it. Section 3 explains how photos are stored and who can reach them.
2.8 Technical and analytics information
Like any website, our hosting provider processes standard technical information in order to serve pages to you, including your IP address, browser type and the pages you requested.
We use Google Analytics 4 to understand aggregate traffic patterns, such as how many people visited a page. Google Analytics sets cookies and collects a pseudonymous identifier for your browser. It is loaded only when a real analytics property is configured for the site: if none is, no analytics script loads at all.
We do not use advertising pixels, retargeting tags or cross-site tracking.
2.9 Marketing email
If you opt in to our email list, for example by downloading a guide or joining a waitlist, we pass your email address and the relevant tag to ConvertKit, our email marketing provider. You can unsubscribe from any marketing email using the link in that email, and that unsubscribe takes effect regardless of whether you keep using the app.
We do not add you to marketing email just because you created an account or bought a subscription. Marketing email is opt in.
3. Photos you attach to a workout
Photos you attach to a workout are uploaded to Vercel Blob and stored with private access. They are not reachable from the open web.
- A photo has no public address. It can only be loaded through the app.
- Every time someone tries to view one, we check who they are and whether you have allowed them to see your workouts. That check happens on each request, not once.
- If you unfriend someone, or change your workout visibility setting, the change takes effect immediately. There is no previously issued link that keeps working.
- If you delete a photo we remove it from the app and delete the stored file. Anyone who already saved a copy of the image itself may still have that copy, which is true of any image anyone can see.
You control who can see your logged workouts, and photos follow that same setting. See section 7 for how to change it.
5. Why we are allowed to use your information
- To perform our contract with you. Your account, your subscription, your program, your logged workouts.
- Because you asked us to. Marketing email, friend connections, photos and comments are all things you choose to switch on.
- For our legitimate interests. Keeping the service secure, preventing abuse, understanding aggregate usage, and holding a record of what you signed.
- To comply with the law, including tax and accounting obligations on payments.
We do not use your information for any automated decision that has a legal or similarly significant effect on you. Your program is generated from your answers, and you can change those answers, but no decision about your access, billing or standing is made automatically from profiling.
6. How long we keep it

When we delete an account, we delete or anonymise the associated data, except records we are required to keep (billing records) or genuinely need to keep (the signed waiver, for the reason above).
7. Your rights over your information
Whatever state or country you are in, you can ask us to:
- See what personal information we hold about you
- Correct anything that is wrong
- Delete your account and your information
- Export a copy of your data in a portable format
- Stop sending you marketing email
- Object to or restrict a particular use of your information
- Withdraw consent you previously gave, without that affecting anything we did before you withdrew it
To do any of these, email daniel.baker@clarity-performance.com from the email address on your account. We will confirm we received your request, and we aim to complete it within 30 days. If a request will take longer, we will tell you why.
We will never charge you for making a request, and we will never treat you differently for making one.
An honest limitation. There is no self-serve delete or export button in the app yet. Deletion and export requests are handled by a person, by email, and that person is the founder. That is workable at our current size and it is why the promise above is one we can actually keep. When the self-serve version ships, this paragraph gets replaced with a link to it.
You can change who sees your logged workouts at any time from your dashboard settings, without emailing anyone.
8. Do we sell your personal information?
No. We do not sell your personal information, and we do not share it for cross-context behavioural advertising.
We are telling you this because it is true today, not because a specific law currently obliges us to. If that ever changes, we will update this policy and tell you before the change takes effect.
9. Children
The Clarity Performance app is intended for adults. You must be 18 or older to create an account and use the service. Both the liability waiver and the program onboarding ask for your date of birth and refuse to continue if you are under 18, because a person under 18 cannot sign an enforceable waiver.
We do not knowingly collect personal information from anyone under 13. If we learn that we have, we will delete it. If you believe a child has given us information, email daniel.baker@clarity-performance.com and we will act on it.
11. How we protect your information
- All traffic to and from the site is encrypted in transit over HTTPS.
- Your password is never held by us. Authentication is handled by Clerk.
- Your card details are never held by us. Payment is handled by Stripe.
- Access to the production database is limited to the people who operate the service.
- Routes that return your data check that the request is signed in and that the data actually belongs to you.
No system is perfectly secure, and we are not going to claim ours is. We are a small operation and we would rather tell you what we actually do than describe an enterprise security programme we do not have.
12. If there is a data breach
If personal information you gave us is exposed in a way that creates a real risk to you, we will tell you. We will tell you what happened, what information was involved, what we have done about it, and what you may want to do yourself. We will do that as soon as we reasonably can after we understand the scope, and we will notify any regulator we are required to notify.
We are deliberately not promising a specific number of hours here, because we would rather give you accurate information slightly later than a fast notice that is wrong.
13. Where your information is held
Clarity Performance is a United States business and our service providers store data on infrastructure primarily located in the United States. If you use the service from outside the United States, your information will be transferred to and processed in the United States, which may have different data protection rules than your own country.
We do not currently target or market the service to people outside the United States.
14. Changes to this policy
If we change this policy we will update the "last updated" date at the top. If a change materially affects how we use your information, we will tell you by email or in the app before it takes effect, rather than quietly editing the page.
