Your Health Data

Last updated 18 October 2026

This is our Consumer Health Data Notice. It is written for Washington State residents, and we apply it to everyone. It adds to our Privacy Policy; where they differ for you, this notice applies.

What counts as health data here

Information that identifies you and is about your physical or mental health. At Clarity Performance that is:

  • your readiness answers: injuries or pain and where, movements to avoid, and your injury notes
  • your body measurements: bodyweight entries and progress photos
  • your training data, where it shows something about your health: workouts, sets and loads, runs and sports, estimated maxes and records
  • check-in answers and photos you send a coach
  • data from Apple Health and the Clarity Apple Watch app, once you log a workout: its heart rate, calories, distance and time
  • GPS routes of the outdoor workouts you record. They are location, not health, but we treat them as health data to be safe.

Why we collect it

Only to provide what you asked for:

  • to keep you safe and keep a record of what you told us and signed
  • to build and adjust your program around what you can and cannot do
  • to show you your progress: records, trends, streaks
  • to let your coach coach you, if you have one

We do not use it for advertising, and we never use it to train AI models.

Where it comes from

From you: when you answer the readiness questions, log training or bodyweight, record a route, upload a photo or answer a check-in; from files you import from other apps; and from Apple Health (including the Clarity Apple Watch app, Garmin, Whoop and other devices that write to it), only after you connect it and only for the workouts you choose to log. We do not buy health data or collect it from anyone else.

Who we share it with

  • Your coach, only while you are coached, and only what the Privacy Policy lists.
  • People you choose: followers or Open Gym see the workouts you post, as you set them. A posted workout can show its calories and average heart rate. A route is shared only if you share it, and never its first and last 200 meters.
  • Our service providers, who process it for us and may not use it for anything else: Neon (database), Vercel and Vercel Blob (hosting and file storage), Clerk (accounts), Apple (notifications in the iPhone app), and Google (email, for a copy of a signed waiver).
  • When the law requires it.

We share it with no one else, and we never sell it.

We never use geofences: the app never draws a virtual boundary around any place, including places that provide health care, and never acts on where you are except to record the route of a workout you started.

Your rights

You can:

  • confirm whether we collect, share or sell your health data, and see it, including the list of everyone we have shared it with. Settings, Your data, downloads everything we hold.
  • delete it: Settings, Privacy, Delete my health answers (your readiness answers, bodyweight, progress photos, routes, and the heart rate and calories from your watch); Settings, Delete account; or email us. We also tell our service providers to delete it.
  • withdraw consent, as above.

Email privacy@clarity-performance.com from your account's email. We answer within 45 days (we may extend once by 45 more if we tell you why). It is free. If we decline, we tell you why, and you can appeal by replying; we answer within 45 days. If you disagree with our answer to an appeal, you can contact the Washington State Attorney General at atg.wa.gov/file-complaint.

One exception to deletion: a signed waiver and its answers are kept, sealed, for 4 years after an account is deleted, only in case of a legal claim (see the Privacy Policy).
